Terms of Service

The agreement between you and ApplyRunner.

Last updated October 18, 2026

Summary

  • You choose how much we do: Review, Hybrid or Auto. We apply only within the limits you set.
  • Applications are built from facts you confirm, and you are responsible for those facts being true.
  • We never use AI to guess hard facts. If we don't know an answer, the application waits for you.
  • We can't promise interviews or offers. Employers make their own decisions.
  • Paid plans renew monthly until you cancel, and you can cancel at any time.

This summary is for convenience. The full terms below control.

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and ApplyRunner LLC ("ApplyRunner", "we", "us" or "our"). They govern your use of our website, applications, job-matching and application service, Penny (our career assistant) and our free career tools (together, the "Service").

By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Section 17 contains provisions on how disputes are resolved, which affect your legal rights. Please read it carefully.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You may use the Service only for your own job search, as an individual, and not on behalf of another person or as a recruiter, agency or employer. You may not use the Service if you are barred from doing so under applicable law, or if we have previously terminated your account.

3. Your account

  • You must give accurate, complete registration information and keep it up to date.
  • You may hold only one account. Accounts are personal and may not be shared, sold or transferred.
  • You are responsible for keeping your sign-in details confidential and for all activity under your account.
  • Tell us promptly at [email protected] if you suspect unauthorized access to your account.

4. The Service

The Service lets you:

  • upload a resume and confirm facts about yourself in an answer bank;
  • find job postings and see a score of how well each one matches you;
  • have your resume reworded and reordered for a particular job, using only your own content;
  • have application forms filled in and submitted on supported hiring systems (currently Greenhouse, Lever and Ashby);
  • see a record of each application, including what was sent;
  • ask Penny, our career assistant, about your matches, applications and resume; and
  • use free career tools, such as the skills gap assessment, some of which work without an account.

If you use a free tool without an account, these Terms apply to that use, except the sections on your account, plans and billing, and applying on your behalf.

We may add, change or remove features, and the hiring systems we support may change. Some job postings will use systems we do not support, and we will not apply to those. We do not guarantee that any particular job, employer or number of jobs will be available.

5. Authorization to apply on your behalf

5.1 Your appointment of ApplyRunner

By choosing an automation mode, you appoint ApplyRunner as your limited agent, for the sole purpose of preparing and submitting job applications in your name, using information you have provided, within the settings you choose. This authority covers nothing else. In particular, we will not accept or decline offers, negotiate, sign documents, take assessments, or communicate with employers on your behalf beyond submitting the application.

5.2 Modes

  • Review mode: we prepare each application and submit it only after you approve it.
  • Hybrid mode: you authorize us to submit, without further approval, applications to jobs at or above the minimum match score you set. Others wait for your approval.
  • Auto mode: you authorize us to submit, without further approval, every application that we can fully answer from your information, within your daily limit and filters.

5.3 Limits and revocation

We will not submit an application where a required question cannot be answered from your information; that application waits for you. You may pause automation, change modes or tighten your settings at any time, and the change applies to every application not yet submitted. A submitted application cannot be withdrawn by us, but you may contact the employer directly.

5.4 Your responsibility for authorized applications

An application submitted within your settings is treated as submitted by you. You are responsible for reviewing your settings, answer bank and application records, and for any statements made in applications that are drawn from information you provided.

6. Your information and its accuracy

  • You confirm that everything you give us, including your resume and answer bank, is true, accurate, current and your own, and you will keep it current.
  • We never use AI to choose or guess factual answers such as work authorization, visa sponsorship, salary, start date, criminal history, or self-identification. These answers come only from your answer bank, and we never select a default option on your behalf.
  • You must not give us information you are not entitled to share, such as another person's details or a former employer's confidential information.
  • Some laws prohibit giving false information to an employer or a government agency. You are solely responsible for the truth of your information, and for meeting any eligibility requirements a job imposes.

7. AI-generated content

  • The Service uses AI to score matches, tailor resumes and draft answers to free-text questions. Tailoring only rewords and reorders content you supplied, and never adds skills, titles, employers, dates or numbers.
  • AI-generated content can still contain errors or wording you would not choose. You can read every answer in your application record, and in Review mode before it is sent. You are responsible for checking content you allow to be sent without review.
  • Match scores and skills assessment results are estimates to help you prioritize. They are not a prediction of whether an employer will hire you.
  • Penny answers from your own information but can make mistakes. It cannot submit applications or change your information, and its replies are not career, legal, immigration or financial advice. Check anything important before you rely on it.
  • As between you and us, you own the tailored resumes and answers generated from your information.

8. Employers and third-party platforms

  • Job postings are created by employers, not by us. We do not verify postings, and we are not responsible for their accuracy, legality or availability, or for the conduct of any employer. Be cautious of postings that ask for payment or sensitive financial information.
  • Applications are submitted through hiring systems operated by third parties, such as Greenhouse, Lever and Ashby. Those systems and employers have their own terms and privacy policies, and their handling of your application is outside our control.
  • We are not an employment agency, recruiter or employer, and we do not act for any employer. Nothing in the Service is career, legal or immigration advice.
  • Employers may change or close postings, reject applications or not respond. We are not responsible for employers' decisions.

9. Acceptable use

You agree not to, and not to help anyone else to:

  • submit false, misleading or impersonating information, or apply under anyone else's identity;
  • apply on behalf of another person, or use the Service as a recruiter, staffing agency or reseller;
  • use the Service in breach of the terms of any employer or hiring system, or in a way intended to overwhelm or disrupt them;
  • ask us to bypass CAPTCHAs, rate limits, access controls or other protections, or to use proxy networks or fake accounts. We do not do these things;
  • upload malware, or probe, scan or test the vulnerability of the Service without our written permission;
  • copy, scrape, reverse engineer or build a competing product from the Service, except as the law expressly permits;
  • resell, sublicense or share access to the Service; or
  • use the Service for any unlawful, discriminatory or harmful purpose.

We may limit application volume, pace submissions, or pause applications to an employer or system, to protect you, employers and the Service.

10. Plans, fees and billing

10.1 Plans

Current plans and prices are shown on our Pricing page, and the plan you select at checkout forms part of these Terms. The Free Trial includes 10 applications, once per person, without payment details. Paid plans include a set number of applications per billing month.

10.2 What counts as an application

An application counts toward your allowance only when it is successfully submitted to the employer's hiring system. Applications that are skipped, waiting for you, or that fail to submit do not count. Your allowance resets at the start of each billing period; unused applications do not roll over.

10.3 Automatic renewal

Paid plans are subscriptions that renew automatically each month at the then-current price, and we will charge your payment method at the start of each billing period, until you cancel. By subscribing, you authorize these recurring charges. You can cancel at any time in your account settings, and cancellation takes effect at the end of the current billing period. You keep access until then. We will send any renewal reminders the law requires.

10.4 Payment, taxes and failed payments

Payments are processed by Stripe, Inc., under its terms. Prices exclude applicable taxes unless stated, and you are responsible for those taxes. If a payment fails, we may retry it, and may suspend paid features until it succeeds.

10.5 Refunds

Payments are non-refundable, including for unused applications or a partly used billing period. You can cancel at any time; cancelling stops the next renewal, and your plan stays active until the end of the period you have paid for. Nothing in these Terms limits any refund or cancellation right you have under the law where you live, including any statutory right to withdraw from a contract within a set period.

10.6 Price changes

We will give you at least 30 days' notice of a price change. It applies from your next billing period after the notice period, and you may cancel before it takes effect.

11. Intellectual property and your content

  • Your content: you keep ownership of your resume, answers and other content you provide ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process, adapt and transmit Your Content only as needed to provide the Service to you, including submitting it to employers you authorize. This licence ends when Your Content is deleted, except for copies already sent to employers.
  • No training: we do not use Your Content to train AI models.
  • Our property: the Service, its software, design and brand belong to ApplyRunner and its licensors. We grant you a limited, revocable, non-transferable licence to use the Service for your personal job search, in line with these Terms. All rights not expressly granted are reserved.
  • Feedback: if you send us suggestions, we may use them without obligation to you.
  • Copyright complaints: to report content you believe infringes your rights, contact [email protected].

12. Privacy

Our Privacy Policy explains how we collect and use personal information, and forms part of these Terms.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

Without limiting the above, we do not warrant that the Service will be uninterrupted or error-free, that every application will be submitted successfully, or that any application will lead to a response, interview or offer of employment. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APPLYRUNNER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, EARNINGS, EMPLOYMENT OPPORTUNITIES, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY, EVEN IF ADVISED OF THEIR POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply to liability that cannot be limited by law, such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence, and do not affect any rights you have as a consumer that cannot be waived.

15. Indemnification

To the extent permitted by law, you will defend, indemnify and hold harmless ApplyRunner and its affiliates, officers, employees and agents from any third-party claims, losses and reasonable costs (including legal fees) arising from (a) false or inaccurate information you provided, (b) your breach of these Terms, or (c) your violation of any law or third-party right. We will notify you of any such claim and may take part in its defense with counsel of our choice.

16. Suspension and termination

  • You may stop using the Service and delete your account at any time in your account settings.
  • We may suspend or terminate your access, with notice where reasonable, if you breach these Terms, if your use creates risk or legal exposure for us, employers or other users, or if we stop offering the Service. If we terminate for reasons other than your breach, we will refund any prepaid fees for the unused part of your billing period.
  • On termination, your right to use the Service ends, pending applications are not submitted, and your data is deleted as described in the Privacy Policy. Applications already submitted remain with the employers who received them.
  • Sections 6, 7, 11 and 13 to 19, and any accrued payment obligations, survive termination.

17. Disputes and governing law

17.1 Informal resolution

Before bringing a claim, you and we each agree to try to resolve the dispute informally, by written notice to the other party describing the dispute and the relief sought (to us at [email protected]), followed by at least 60 days of good-faith discussion.

17.2 Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. If you are a consumer living in a country that gives you the benefit of mandatory protections of its own law, nothing in these Terms takes those protections away.

17.3 Forum

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Delaware, and you and we consent to their personal jurisdiction. Either of us may instead bring an individual claim in a small-claims court where it qualifies.

17.4 Time limit

To the extent permitted by law, any claim must be brought within one year after it arises.

18. Changes to the Service and these terms

We may update these Terms from time to time. We will post the updated Terms here with a new "Last updated" date and, for material changes, notify you by email at least 30 days before they take effect. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not agree, you may cancel before the change takes effect. Changes will not apply retroactively, or to a dispute already notified under Section 17.1.

19. General terms

  • Entire agreement: these Terms, the Privacy Policy and your plan details are the entire agreement between you and us about the Service.
  • Severability: if any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms remain in effect.
  • No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment: you may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets, with notice to you.
  • Force majeure: neither party is liable for delays or failures caused by events beyond its reasonable control, including outages of third-party hiring systems.
  • Notices: we will send notices to the email address on your account. You must send legal notices to [email protected].
  • Electronic communications: you agree to receive agreements, notices and disclosures electronically.
  • Export and sanctions: you may not use the Service where prohibited by export control or sanctions laws.
  • Relationship: apart from the limited agency in Section 5, nothing in these Terms creates a partnership, joint venture, employment or fiduciary relationship.
  • No third-party beneficiaries: these Terms do not give rights to anyone other than you and us.
  • Language: if these Terms are translated, the English version controls to the extent permitted by law.
